 These are the terms and conditions of sale that you must agree to comply with before making any purchase from Wild Oak Design.
PLEASE READ THE FOLLOWING
I recommend you familarise yourself with these as you will be bound by these terms once you have made your purchase, regardless of whether you chose to read them or not!
Copyright
You must agree to leave my store credit intact as credit for my work for the lifetime of the template.
This means that my store credit MUST remain exactly as it appears when I send your design - wherever it appears on your design. The entire content of my template and custom design work is © Wild Oak Design and is subsequently protected by International Copyright Laws. That means, the entire content of my work (including the HTML code, graphics, images, artwork and design) cannot be be broken up, distributed, copied, re-used or resold without my explicit written consent. Ebay templates are for use within the Ebay system unless specific written permission to use them elsewhere has been approved.
Ebay templates are designed, coded and sold for use within ebay. Any purchases made for use at a personal website will have the links removed and the remaining design sold for use as-is. No other amendments to the design or HTML code will be made for personal website use.
Website designs are for use at Pappashop WebHosting only and cannot be installed or carried over anywhere else.
Wherever you are using my templates, my credit must remain intact and visible at all times.
Your purchase buys you license to use my graphics and designs - not ownership of them. Ebay template graphics will be hosted by me. They must not be copied to a personal photohost or server. All images and graphics installed into a customers website will remain the property of Wild Oak Design.
No graphics installed into a website can be shared, distributed or used as one's own under any conditions.
Requests for Alterations
All of my Pre-Made and OOAK ebay template designs are sold as-is. I simply cannot accommodate changes (no matter how small they may appear to you) to these designs for these prices.
Please do not make requests for changes (including fonts, layout, design, colour or any other area of design) to any part of the templates in my Pre-Made range unless you are prepared to pay an additional 'Amendment Fee'.
My Amendment fee is charged in accordance with my regular hourly rate and charged in per 15 minute increments. In the event that you request changes and I agree to make them, you will be quoted an Amendment Fee and an invoice will be raised. Requested design amendments will be decided at my discretion.
Each of my Auction templates is coded in accordance with eBay regulations at the time of purchase. In the event that you require any changes to your template at any time after delivery of your template as a result on changing requirements by the template host, I am not at liberty to revise any part of your design or HTML code. Should you require amendments to your template at any time after purchase, you will be charged in accordance with my hourly rate.
Strictly Prohibited Alterations
Changing ANY part of my designs results in a product that does NOT reflect my own design work and subsequently renders my credit fraudulent.
Therefore the following Terms must be strictly adhered to:
It is a serious breach of terms to change the content and/or layout of my template in areas you have not been given written permission to do so. Any changes made to my designs do not accurately depict my work and therefore render my credit void. This will not be tolerated.
Revision Allowances
Custom Designs incur a maximum allowance of three design revisions from delivery of initial concept design - and then one additional revision request per product for every matching purchase thereafter.
For example: if you purchase a Custom Designed template - after my initial design concept is presented to you - you can request changes be made up to three times. If you then purchased a matching Business Card, you would be allowed to request one design change.
Any OOAK or Pre-Made design is sold as-is and any subsequent matching item purchases also have an allowance of one design alteration request.
Any further requests for alterations outside of these allowance will incur my hourly rate (or part thereof) until the design has been approved.
Printables & Disclaimer Each of the printable products I design are created using the CYMK color format and created in 300dpi resolution. Vista Print product templates are used wherever possible.
All my printable designs are printed on three home printers for print testing before being sent to you. Because print quality and color varies so greatly between printers, it is a requirement that you print these yourself upon receipt to ensure they are to your satisfaction.
You will be required to complete a Quality Assurance form at receipt of your order which acknowledges you accept the quality of my work as delivered to you. Any requests for color/design/text modification must be made within 7 days of delivery of your order.
Note: The above procedures ensure you are 100% happy with the quality of the product as you have received and tested it. I will not be held responsible for final product quality - as outsourced print processes and technology are beyond my control.
Images In each of your template codes, there will be explicit instructions indicating the maximum image size allowed in your templates.
If you insert and image that is larger than the stipulated image size, your template may distort and render the entire layout ineffective.
In this case, I am at liberty to remove your template graphics from my server thus rendering your template void. I am not required to reimburse purchase costs as a result of breaches of these terms.
I do not supply individual graphics used in your templates or site design. Your purchase buys you the overall site or template design.
Refunds
Due to the nature of the product, I do not accept requests for refunds. Any monies already paid against any design will not be refunded should you decide to cancel your order. This includes any deposits paid against Custom Designs.
It is the responsibility of the purchaser to ensure the website design template and/or webhosting service (ie: Pappashop) will meet your requirements prior to purchase as no refunds will be issued after purchase.
...................................... In the event you do not comply with these terms, you will be sent one reminder email requesting you remove or rectify your offending material. If you choose not to comply with this request, I will exercise my rights with the relevant authorities to have the matter addressed.
All the images and graphics I use in my ebay templates are hosted individually for your order and these will be removed from my webhost, thereby rendering your template(s) null and void. Note: I am not required to refund any monies as a result of your template being removed from my server as a result of breach of terms. All of these terms are covered legally and recognised internationally under the Copyright Infringement Act. | |||
